Terms and Conditions
Definitions
"Company" means AMCG Ltd., and its DBA name GroPower. "Customer" means the person(s) or company whose order for the Goods is accepted by the Company. "Goods" means any goods or services which the Company is to supply to the Customer.
All orders are accepted by the Company subject to and in accordance with the following Conditions of Sale which override and exclude any other terms stipulated or incorporated or referred to by the Customer during any negotiations or in any course of dealing between the Company and the Customer.
Calculator
The carbon footprint calculator has been produced on a best efforts basis. The metrics used in the calculator are based on publically and freely available data. AMCG Ltd. has taken reasonable steps to ensure the calculated results are as accurate as possible, but cannot be held liable for any errors or omissions.
Carbon emissions are inherently difficult to calculate.There are many contributing factors to carbon emissions and much debate over what to calculate and how. AMCG Ltd. maintains the service as a means for individuals and businesses to begin taking responsibility for their impact on the planet. Carbon offsets should be considering a starting point towards environmental responsibility and should be followed up with strategies and actions designed to reduce your actual carbon footprint.
AMCG Ltd., from time to time will update the calculator as new and more accurate data on carbon emissions becomes available.
Sales
On purchase of a carbon offsets, the Company will provide reasonable proof of actions, taken no later than 180 days after the purchase, intended to offset the promised quantity of carbon emissions.
The Company reserves the right to decline to trade with any other company or person.
Legal Construction/ Force Majeure /Exports
The Company shall not be liable for any damage, loss or expense resulting from the failure to give advice or information or the giving of incorrect advice or information whether or not due to the negligence of the Company, its employees, agents or subcontractors.
All matters that may require legal determination as a result of this agreement shall be determined within the court jurisdiction of United Kingdom.
The Company shall not be liable to the Customer in any manner or be deemed to be in breach of these Conditions of Sale because of any delay in performing or any failure to perform any of the Company's obligations under these Conditions of Sale if the delay or failure was due to any cause beyond the Company's reasonable control (which shall include, but not be limited to government actions, war, fire, explosion, flood, acts of terrorism, import or export regulations or embargoes, labor disputes or inability to obtain or a delay in obtaining supplies of Goods or labor). The Company may, at its option, delay the performance of, or cancel the whole or any part of a Contract.
